On the evening of September 5, President Trump issued an Executive Order (EO) titled “Modifying the Scope of Reciprocal Tariffs and Establishing Procedures for Implementing Trade and Security Agreements.” The EO narrowly alters the scope of goods exempt from reciprocal tariffs under Annex II of EO 14257 (April 2). These changes take effect at 12:01 a.m. Eastern Time on September 8, 2025. The EO also identifies products that may qualify for reciprocal tariff exemptions in the future.
A link to EO is here, and the White House Fact Sheet is here. A spreadsheet listing the new and removed exemptions can be found here.
Key Provisions:
- New Exemptions: Certain goods in Chapters 25, 26, 28, 29, 47, 71, 72, 75, 79, and 85 will be excluded from reciprocal tariffs. This covers certain critical minerals, “bullion-related articles,” and pharmaceutical products subject to ongoing Section 232 investigations.
- Removed Exemptions: The EO removes some products from Annex II, which will now be subject to reciprocal tariff coverage – these products are in Chapters 28, 38, and 39. All additions and removals to Annex II are listed by HTS code in Annex I of the Order.
- Future Adjustments: The annexes also identify categories of goods that may qualify for a zero percent reciprocal tariff rate under “deals” reached with aligned partners. These products are listed by HTS code in Annex III of the Order and include certain goods not grown, mined, or naturally produced in sufficient U.S. quantities, certain agricultural products, aircraft and aircraft parts, and some pharmaceutical-use inputs.
